User Terms and Conditions

By accessing this webpage or mobile application (collectively, the “Platform”), you are agreeing to be bound by these Terms and Conditions (“Terms”) in a legally binding agreement between Light Up (referred to as “Light Up”, “we”, “us”, or “our”) and the User (“you” or “your”). Please read these Terms carefully before accessing or using the Platform. If you do not agree to the Terms, you may not access or use the Platform.

We reserve the right to update and change the Terms by posting updates and changes to the Platform. You are advised to check the Terms from time to time for any updates or changes that may impact you. If at any point such amendments are not acceptable to you, we advise you to cease using the Platform at such time.

ELIGIBILITY
You hereby represent and warrant that you are at least 18 years old, have the right, power, and authority to agree to the Terms, to become a party to a legally binding agreement, and to perform your obligations hereunder. If you are using the Platform on behalf of a minor or another person, you represent that you are their legal guardian or authorized representative. You must comply with all applicable laws, including those related to consumer protection, data privacy, and service bookings in India.

DEFINITIONS
- “Payment Instrument” includes credit card, debit card, bank account, prepaid payment instrument, Unified Payment Interface (UPI), Immediate Payment Service (IMPS), or any other methods of payments developed or added by banks and financial institutions from time to time.
- “Platform” refers to the website, mobile application, or any other digital platform where Light Up offers its services and where a Booking may be initiated.
- “Booking” shall refer to the request placed by the User with Light Up to avail services like live music performance etc listed on the Platform for special occasions at home or given venue by paying the Booking Amount.
- “Booking Amount” shall mean the amount paid by the User in connection with a Booking, including service fees, taxes, and any additional charges.
- “User/Users” means any person browsing, registering, or availing services offered on the Platform, including customers and professionals.
- “Professionals” means independent service providers partnered with or listed on the Platform to deliver services.
- “Services” means Live music etc availed for a special occasion at home or given venue.

LIGHT UP'S RIGHTS
You agree that we may collect, store, process, and share your information (including personal data such as name, contact details, location, and payment information) as necessary to facilitate Bookings, deliver Services, improve the Platform, comply with legal obligations, or contact you regarding your Booking or feedback. We may also use your data for analytics, marketing (with your consent where required), and fraud prevention. Your information may be shared with Professionals, payment gateways, or third-party service providers solely for fulfilling Bookings.

YOUR RESPONSIBILITIES
You agree to provide true, complete, and up-to-date information about yourself, including personal details (name, email, phone number, address, age, gender, or other details required for Bookings) and accurate payment information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.

For Bookings, you agree to:
- Be present at the scheduled time and location or provide accurate instructions.
- Ensure safe access to the premises and inform Professionals of any hazards.
- Pay the full Booking Amount through the Platform using legitimate funds.
- Treat Professionals with respect and not engage in any discriminatory, abusive, or unlawful behavior.

PROHIBITED ACTIONS
You may not access or use the Platform for any purpose other than availing or providing Services as intended. The Platform may not be used in connection with any commercial endeavors except those endorsed by us.

As a User, you agree not to:
- Systematically retrieve data or content from the Platform to create collections, databases, or directories without written permission.
- Make unauthorized use of the Platform, including collecting user information for unsolicited communications or creating fake accounts.
- Circumvent or interfere with security features, including those restricting content copying or access limitations.
- Trick, defraud, or mislead us, Professionals, or other Users, especially regarding sensitive information.
- Make improper use of support services or submit false reports.
- Engage in automated use (e.g., scripts, bots, data mining) without permission.
- Interfere with or disrupt the Platform, networks, or connected services.
- Impersonate others or harass, abuse, or harm any person via the Platform.
- Use the Platform to compete with us or for unauthorized revenue-generating activities.
- Reverse engineer, decompile, or copy the Platform's software (e.g., HTML, JavaScript).
- Upload viruses, malware, or disruptive materials (e.g., spam).
- Use the Platform inconsistently with applicable laws, including discrimination or illegal activities.
- Cancel Bookings repeatedly without valid reason or no-show, leading to potential account suspension.

BOOKINGS AND PAYMENTS
Upon initiating a Booking, you enter a legally binding contract with Light Up (and the assigned Professional) to avail the Services at the displayed price. Payments must be made via accepted Payment Instruments on the Platform. We use secure third-party gateways and disclaim liability for unauthorized use of your Payment Instrument due to your negligence.

- Prices include service fees, materials (if applicable), and taxes (e.g., GST).
- You authorize us to charge the Booking Amount, including any adjustments for additional work (with your prior approval).
- Cancellations/Rescheduling: Subject to our cancellation policy (e.g., free up to 24 hours before; fees may apply closer to the slot). No-shows may incur full charges.
- Professionals are independent contractors; we facilitate but do not employ them.

LIMITATION OF LIABILITY
Light Up acts as a technology platform facilitating Bookings between Users and Professionals. We do not guarantee the quality, timeliness, or safety of Services, which are provided by independent Professionals. Your sole recourse for defective, delayed, or unsatisfactory Services is to request a re-performance, refund, or resolution through our grievance process, subject to verification.

We disclaim liability for:
- Any losses, damages, or injuries arising from Services, including property damage or personal harm.
- Delays, cancellations, or no-shows by Professionals.
- Inaccuracies in Professional profiles or Service descriptions.
- Unauthorized transactions or payment issues not caused by us.

In no event shall Light Up's total liability exceed the Booking Amount paid for the affected Service. We shall not be liable for indirect, consequential, or punitive damages.

You indemnify and hold harmless Light Up, its affiliates, and representatives from any claims, losses, or damages arising from your breach of these Terms, misuse of the Platform, or interactions with Professionals.

GUIDELINES FOR REVIEWS AND RATINGS
You may leave reviews or ratings for Services or Professionals. Reviews must:
- Be based on firsthand experience.
- Not contain profanity, abuse, hate speech, discrimination, or illegal references.
- Not be affiliated with competitors for negative reviews.
- Be truthful and not misleading.

We may moderate, reject, or remove reviews at our discretion without liability. By posting, you grant us a perpetual, royalty-free license to use, modify, and display your reviews.

REFUNDS AND CANCELLATIONS
Refunds are processed per our policy:
- Full refund for cancellations within policy window or if Service not provided.
- Partial/no refund for no-shows, partial completion, or user-caused issues.
- Refunds via original payment method within 7-10 business days.
- Disputes over double charges, fraud, or unauthorized transactions: Contact support with proof.

GOVERNING LAWS & DISPUTE RESOLUTION
These Terms are governed by the laws of India. Courts in Bengaluru shall have exclusive jurisdiction.

Any Dispute arising from these Terms or Bookings shall be resolved by arbitration in Bengaluru under the Arbitration and Conciliation Act, 1996. A sole arbitrator shall be appointed mutually or per the Act. Proceedings in English; award final and binding. Parties may seek injunctive relief from Bengaluru courts. Arbitration costs borne as per award.

GRIEVANCE REDRESSAL
For complaints (e.g., Service issues, payments, refunds, Professional conduct), contact our Grievance Officer at [email/support link, e.g., support@lightup.com] or via the Platform. We aim to resolve within 30 days. Escalate to relevant consumer forums if unresolved.

DISCLAIMER
- Services are facilitated "as is"; no warranties on outcomes, Professional availability, or Platform uptime (though we strive for 99% availability).
- We may suspend/terminate access for violations.
- Platform may contain third-party links; we are not responsible for them.
- Force majeure: No liability for delays due to events beyond control (e.g., natural disasters, pandemics).
- Upon Booking, you use legitimate funds and accurate details. We disclaim liability for payment declines, errors, or fraud not attributable to us.
- Treat login information confidentially.
- Content is for informational purposes; not professional advice.
- We are not liable for bugs, viruses, or your device configuration—use antivirus software.

By using the Platform, you acknowledge reading, understanding, and agreeing to these Terms, our Privacy Policy, and any service-specific guidelines.

Additional Terms

Upon completing a Transaction, you are entering into a legally binding and enforceable agreement with us to purchase the product and/or service. After this point the User may cancel the Transaction unless it has been specifically provided for on the Platform. In which case, the cancellation will be subject to the terms mentioned on the Platform. We shall retain the discretion in approving any cancellation requests and we may ask for additional details before approving any requests. Once you have received the product and/or service, the only event where you can request for a replacement or a return and a refund is if the product and/or service does not match the description as mentioned on the Platform. Any request for refund must be submitted within three days from the date of the Transaction or such number of days prescribed on the Platform, which shall in no event be less than three days. A User may submit a claim for a refund for a purchase made, by raising a ticket here or contacting us on seller+a4d48186912b4210b50aa5ff0d6c1216@instamojo.com and providing a clear and specific reason for the refund request, including the exact terms that have been violated, along with any proof, if required. Whether a refund will be provided will be determined by us, and we may ask for additional details before approving any requests.
